Comment: Implementation of the Individuals with Disabilities Education Act 2013
In comments to the Office of the State Superintendent for Education (OSSE), Children’s Law Center says a proposed policy manual could be a useful tool for families in understanding the legal requirements of Part C of the Individuals with Disabilities Education Act, but recommends some revisions to three aspects of the policy. Children’s Law Center recommends:
- extending the definition of diagnosed condition to match DE and federal regulations, as well as the DC Early Intervention Program’s list of established conditions in its existing policy guidance
- extending the policy’s proposed overly restrictive limitations on the use of informed clinical opinion to establish eligibility
- adding explanation of an option to extend early intervention services past a child’s fourth birthday, which will go into effect next year
